California sues health products maker over unit dangers

There are times when we are hurt by our own mistakes or an element of chance in our lives. Accidents are often easy to write off as happenstance and recovery does not take too long. But in some cases, our pain is the result of the actions or inactions of other people and we are owed damages for that consequence.

Many personal injury claims for financial damages result from something direct, like a traffic accident or a manager's inability to keep a public space clean and safe. However, personal injury can result from a variety of activities, including deceptive marketing practices.

A judge in San Diego issued an 88-page ruling that ordered a health care products manufacturer to pay more than $300 million as a result of their marketing practices. The jurist found that the company profited from the marketing of a product without communicating the risks that may be included in using it.

The state of California has been involved in the issue since 2016, when it sued the company for false advertising and unfair competition with its surgical products unit. The attorney general in Sacramento said the firm put profits ahead of the health of millions of women and the options of the doctors who recommended and used the products.

Anyone who has been harmed by a company's or individual's actions may have a lawsuit to file in civil court to claim damages. Financial damages may go towards recovery or compensation for the harm and trouble people experienced. An attorney can outline these options with more clarity in difficult times.
