When You Are Injured in a Taxi or Other Ride for Hire
Contrary to what taxi advocates will try to tell you, traveling by cab, while apparently somewhat safer than driving yourself, still poses significant risk of injury. In a recent study, persons riding in taxis were involved in just under five accidents per one million miles, whereas people riding in other vehicles experienced an average of 6.7 accidents per million miles. So what are your options when you have been injured in a motor vehicle accident involving a taxi.
As a general rule, a claim for damages in a motor vehicle accident is typically based on a legal theory of negligence. Under negligence principles, every person (including operators of motor vehicles) has a duty to engage in all activities with reasonable care. That means that they must act as an average person with ordinary prudence would. Driving at an excessive rate of speed or under the influence of drugs or alcohol will typically not be considered reasonable, nor would ignoring traffic lights, signs or laws while behind the wheel.
Accordingly, when you have been in a motor vehicle accident, you want to identify every potential factor that may have contributed to the accident, such as:
- Operator error or misjudgment
- A defect in or malfunction of a critical component of one of the cars in the accident
- Roadway defects, broken signs, lights that don’t work properly
If the driver of your cab was speeding or otherwise violating the law, you may be able to show that such violation caused the accident. In addition, if the driver of the cab could have reasonable avoided the crash, that may be a basis for financial recovery.
As a general rule, most cab operators carry a specific amount of liability insurance that will cover their losses when you are injured. With the more reputable “ride share companies,” such as Uber, Lyft, Sidecar and Haxi, drivers have the same type of coverage.
